Terms and Conditions (T&Cs)
Just-Swim – Dean Vrakela

1. Scope of Application
These Terms and Conditions apply to all swimming courses, private and duo lessons, as well as any other services offered by Just-Swim, owned by Dean Vrakela.

2. Registration and Contract Formation
Registration for courses or individual lessons may be made in writing, online, or verbally and constitutes a binding request. A contract is concluded once a course place or appointment has been confirmed by me.

3. Course Organization
Courses take place at the indoor or outdoor pool in Bruchköbel. Changes to schedules or group allocations may be necessary for organizational reasons and will be communicated in due time.
Group sizes are limited to ensure safe and individualized instruction.

4. Participation Requirements
Participation requires that the child or participant is physically able to take part in swimming lessons. Any relevant medical conditions must be communicated prior to the start of the course.

5. Fees and Payment Terms
All prices are exclusive of pool admission and, in accordance with Section 19 of the German VAT Act (small business regulation), no VAT is charged.
Open courses are billed per session or via a 10-lesson pass. Only lessons actually attended will be charged.
10-lesson passes are personal and non-transferable.

6. Absences and Cancellations
For open courses and private lessons, no charges apply if a participant does not attend.
For fixed courses (e.g. 10-week programs), there is no entitlement to make-up lessons or refunds in the event of absence, regardless of the reason.
If a lesson is cancelled for organizational reasons on my part, it will either be rescheduled or not charged.

7. Duty of Supervision
Supervision begins and ends with the lesson time in the pool area. Parents or guardians remain responsible for supervision during the time spent at the swimming facility. Parents are welcome and encouraged to be present during the lessons.

8. Liability
Participation is at the participant’s own risk. Liability for simple negligence is limited to breaches of essential contractual obligations. Any further liability is excluded to the extent permitted by law.
No liability is assumed for personal belongings brought to the facility.

9. Data Protection
Personal data is used exclusively for the organization and delivery of the courses and will not be shared with third parties. Further information can be found in the privacy policy.

10. Final Provisions
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
German law shall apply.
In case of discrepancies, the German version of these Terms and Conditions shall prevail.
